The Supreme Court on Monday afternoon refused to grand relief to Massachusetts hospital workers who were challenging a vaccine mandate. Justice Steven Breyer denied relief without referring the case to his colleagues on the court. There was no explanation why the justice denied the emergency injunction. The workers seeking relief were from Mass General Bingham and were seeking relief after the hospital started enforcing the mandate on November 5th. The workers are claiming that “Mass General is violating their Title VII rights and the Americans with Disabilities Act by enforcing the vaccine mandate without accommodation — something their Supreme Court petition claims has been offered to other employees.”

This is the fourth case to get denied an emergency injunction on the so-called Supreme Court shadow docket. The other cases were from Maine health care workers, New York Public School teachers, and Indiana University students.
